CHRGJ Faculty Director Professor Ryan Goodman and NYU Distinguished Scholar in Residence Professor Harold Koh presented, with a group of foreign and comparative law experts–Sarah Cleveland, Thomas Buergenthal, Lawrence Helfer, and Sujit Chowdry–an amicus brief to the Supreme Court on same-sex marriage equality. The brief, written in support of the petitioners in Obergefell v. Hodges, demonstrates foreign jurisdictions’ affirmation of equal marriage rights and explains the importance of same-sex marriage equality in guaranteeing citizens’ liberty and due process. Goodman, Koh and the other foreign law experts, provide an overview of court decisions made by other liberal democracies recognizing full marriage equality based on the principles of due process and liberty that the Court should take into consideration and examine how foreign jurisdictions have successfully balanced same-sex marriage equality with religious freedom. They also stress that the Court’s decision may have far-reaching influence in promoting equal rights for LGBTQ couples across the world.
